Proprietary Rights/Limited License.

Unless otherwise noted, the Site, and all features and materials on the Site, including text, graphics, thumbnails, illustrations, images, photographs, video clips, and other content, and the copyrights, trademarks, trade dress, trade names and/or other intellectual property in such materials (collectively the "Contents"), are owned, licensed or otherwise controlled by InternetPrivacyScore. The compilation of the Contents included in or made available on the Site is the exclusive property of InternetPrivacyScore, and protected by copyright law. InternetPrivacyScore and its suppliers and licensors expressly reserve all intellectual property rights in the Contents. From time to time there may be information on the Site that is inaccurate or incomplete, or that contains typographical errors. InternetPrivacyScore reserves the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information on the Site is inaccurate at any time without prior notice (even after you have submitted your order).

InternetPrivacyScore authorizes you to view the Contents on the Site. You may not use the Site or any Contents for commercial purposes or in any way that is unlawful, or harms us or any other person or entity, as determined in our sole discretion. You may not otherwise copy or download Contents, and may not modify, use or distribute the Contents, the Site, or any related software in any way unless you obtain the written permission of InternetPrivacyScore. In the event you download Contents as permitted under this Terms & Conditions of Use, you agree to retain all copyright and other proprietary notices contained on the Contents. If you violate these Terms and Conditions, your permission to use the Contents terminates, and you agree to immediately destroy all copies of the Contents.

Prohibited Uses and Activities.

The Site may not be used (a) to transmit, distribute, store or destroy material, including without limitation the Contents, in violation of any applicable law or regulation; (b) in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of others or violate the privacy, publicity or other personal rights of others; or (c) to transmit, distribute or store material that is defamatory, obscene, threatening, abusive or hateful. The Site may not be used for any illegal purpose or in any manner that would subject InternetPrivacyScore, its affiliates, or any of the users of the Site to liability.

You agree that you will not use the Site for any of the following: (a) providing InternetPrivacyScore with, or transmitting or posting, any incomplete, false or inaccurate information; (b) deleting or revising any material or Contents posted by InternetPrivacyScore or any other person or entity without authorization; (c) harvesting or collecting personally identifiable information about other users of the Site; (d) using the Site to defame, harass, stalk, threaten, or otherwise violate the legal rights of others, including privacy or publicity rights; (e) using any device, software or routine to interfere or attempt to interfere with the proper working of the Site or any activity conducted on the Site; (f) taking any action which imposes an unreasonable or disproportionately large load on the Site's infrastructure; (g) if you have a Customer ID, Order ID, username or password, allowing unauthorized access to a non-registered user to a non-public area of the Site, disclosing to or sharing your Customer ID, Order ID, username or password with any third-party or using your Customer ID, Order ID, username or password for any unauthorized purpose; (h) using or attempting to use, without InternetPrivacyScore's permission, any engine, software, tool, agent or other device or mechanism (including without limitation browsers, spiders, robots, avatars or intelligent agents) to navigate or search this Site other than the search engine and search agents available from InternetPrivacyScore on this Site and other than generally commercially available third-party web browsers (e.g., Microsoft Internet Explorer, Google Chrome, Mozilla FireFox, and Safari); (i) attempting to decipher, decompile, disassemble or reverse engineer any of the software comprising or in any way making up a part of this Site; (j) aggregating, scraping, extracting, data mining, or duplicating in any manner any of the Contents or information available from the Site, except as otherwise expressly allowed by these Terms and Conditions; or (k) framing or linking to any of the Contents or information available from the Site without InternetPrivacyScore's written permission.

You are prohibited from violating or attempting to violate the security of this Site, including without limitation, (a) accessing data not intended for your access or logging into a server or account which you are not authorized to access; (b) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization; (c) attempting to interfere with service or functionality to any user of the Site, host or network, including without limitation, via means of submitting material that contains viruses, Trojan horses, worms, time bombs, cancelbots or other computer programming routines or engines or software code that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or information or by any activity of overloading, flooding, spamming, mailbombing, or crashing this Site or its associated services; (d) sending unsolicited e-mail, including promotions and/or advertising of products or services through this website or to other users of this Site; or (e) forging any TCP/IP packet header or any part of the header information in any e-mail or posting relating to this Site

Right to Limit / Deny Access.

InternetPrivacyScore reserves the right to prohibit any user further access to its Site for violating these terms and conditions or any law. InternetPrivacyScore may take any action with respect to user-conduct that it deems necessary or appropriate, in its sole discretion, if it believes it may create liability for InternetPrivacyScore, damage InternetPrivacyScore's image, cause harm to others, cause InternetPrivacyScore to lose (in whole or in part) the Site; or cause InternetPrivacyScore to lose (in whole or in part) the services of its ISPs or other suppliers.

Third Party Links.

InternetPrivacyScore provides links to third party websites solely as a convenience to you and not as an endorsement. Such links have not been reviewed by InternetPrivacyScore, and InternetPrivacyScore assumes no responsibility for the content of any sites linked to this Site. InternetPrivacyScore is further unable to inspect or confirm that the materials or information contained on the site that are linked to the Site are correct in every case.

User Comments, Feedback and Other Submissions.

InternetPrivacyScore welcomes your feedback and comments regarding our products and services, as well as photos, videos and other content (collectively "User Submissions"), at various places in the Site, including third party sites where we post content or invite your feedback, such as www.facebook.com/InternetPrivacyScore, www.twitter.com/InternetPrivacyScore, and www.instagram.com/InternetPrivacyScore ("Social Media Platforms"). In addition to these Terms and Conditions, there are Guidelines that apply to your activities on our pages on such Social Media Platforms. Please note, however, that InternetPrivacyScore does not control those Social Media Platforms, and these Terms and Conditions and our Guidelines do not apply to companies that InternetPrivacyScore does not own or control, or to the actions of people that InternetPrivacyScore does not employ or manage. You may not use a false email address, impersonate any person or entity, or otherwise mislead InternetPrivacyScore or third parties as to the origin of the User Submissions. InternetPrivacyScore reserves the right (but not the obligation) to remove or edit such content but does not regularly review posted content. InternetPrivacyScore takes no responsibility and assumes no liability for any User Submissions posted by you or any third party.

Please note that we are not responsible for, and we do not endorse, the opinions, advice, suggestions or recommendations posted or sent by users in any User Submissions and we specifically disclaim any liability in connection therewith to the fullest extent allowed by applicable law.

DMCA Notice – Notice and Procedure for Making Claims of Copyright Infringement.

InternetPrivacyScore respects the rights of all copyright holders and we ask visitors to our site to do the same. Our policy is to respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act ("DMCA"), and you agree to comply with the processes outlined below in the event you are involved in any claim of copyright infringement to which the DMCA may be applicable. IF SUBJECT MATTER JURISDICTION (INCLUDING DIVERSITY JURISDICTION) DOES NOT EXIST IN THE UNITED STATES DISTRICT COURT FOR THE SOUTHERN DISTRICT OF FLORIDA, THEN THE EXCLUSIVE FORUM AND VENUE FOR ANY SUCH ACTION SHALL BE THE COURTS OF THE STATE OF FLORIDA, LOCATED IN BROWARD COUNTY, AND YOU SUBMIT TO THE PERSONAL JURISDICTION OF THAT COURT.

YOU AND INTERNETPRIVACYSCORE AGREE THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW, EACH MAY BRING DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF THIS SITE AND/OR THESE TERMS AND CONDITIONS AGAINST THE OTHER ONLY IN YOUR OR THEIR INDIVIDUAL CAPACITIES IN THE FORUM DESIGNATED IN THIS SECTION, AND, IN SO DOING YOU AND INTERNETPRIVACYSCORE HEREBY WAIVE THE RIGHT TO A TRIAL BY JURY, TO ASSERT OR PARTICIPATE IN A CLASS ACTION LAWSUIT (EITHER AS A NAMED-PLAINTIFF OR CLASS MEMBER) AND TO ASSERT OR PARTICIPATE IN ANY JOINT OR CONSOLIDATED LAWSUIT. YOU AND INTERNETPRIVACYSCORE FURTHER AGREE THAT, EXCEPT FOR WHERE OTHERWISE PROHIBITED BY LAW, ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY), BUT IN NO EVENT WILL ATTORNEYS' FEES BE AWARDED OR RECOVERABLE.

User Generated Content Policy.

In addition to InternetPrivacyScore Terms and Conditions, which terms and definitions are incorporated by reference, this User Generated Content Policy (the "Policy") governs all User Submissions that you upload, post, email or otherwise transmit via or to the Site, including through Social Media Platforms (such as Facebook, Twitter, Youtube, or Instagram), and including the submission of product and service ratings and reviews and all other data, profile information, documents, text, software, applications, music, sound, photographs, graphics, video, messages, forum postings, comments, questions, answers or other materials.

InternetPrivacyScore is pleased to hear from users and welcomes your comments regarding our products and services. Please keep in mind, however, that you are responsible for ensuring that your User Submissions comply with this Policy, and with any applicable law. By making a User Submission to InternetPrivacyScore, you represent and warrant that:

Your User Submissions will be accurate, truthful and not false or misleading
Your User Submissions are not, or would not reasonably be considered to be, unlawful, libelous, obscene, bullying, vulgar, offensive, abusive, threatening or harassing to any individual or entity
Your User Submissions will not violate the rights of any person or entity, including without limitation copyright, trademark, trade secret, privacy, publicity, confidentiality, or other personal or proprietary rights
Use of your User Submissions will not cause injury to any person or entity
You own or otherwise control all of the rights to the User Submissions you provide and you have the full authority to provide the non-exclusive license outlined below to InternetPrivacyScore to use all of the intellectual property rights and other rights in the User Submissions in the manner contemplated by the Site and this Agreement
You understand that your User Submissions will not be returned and may be utilized, exploited, and/or distributed by InternetPrivacyScore commercially and in its advertising and marketing materials, including but not limited to, online and in television broadcasts, store materials and social media, without any compensation to you
You shall comply with the Federal Trade Commission's Guides on the Use of Endorsements and Testimonials in Advertising. This means, for example, that if you received compensation in any form (including free product) or any other incentive (such as an entry in a sweepstakes or contest or a coupon) in exchange for posting content on the Site (including but not limited to product reviews, photographs, and on social channels), then you must disclose this in your posting. All disclosures must be made clearly and conspicuously
All "moral rights" that you may have in such User Submissions have been voluntarily waived by you and you do not require that any personally identifying information be used in connection with your User Submissions, or any derivative works of or upgrades or updates thereto
You understand you are participating in a public forum and that your User Submission will be available to all other users of the Site and potentially Social Media Platforms. You further understand that InternetPrivacyScore has no control over any User Submissions once it leaves the Site, and that others may duplicate material found on the Site
Your User Submissions are not submitted for compensation or other consideration from a third party. Your User Submissions also are not a form of phishing and do not contain any unsolicited or unauthorized advertising
Your User Submission does not include any personally identifiable information of any third party and does not reference any other websites
Your User Submission does not contain any computer viruses, worms or other potentially damaging computer programs, files or malware
You are at least 13 years old and, if you are a minor, that you have obtained the consent of your parent or legal guardian to use the Site and agree to these terms, and
That use of the User Submissions you supply does not violate InternetPrivacyScore Terms and Conditions, and will not cause injury to any person or entity.

By sending User Submissions or any other communications to the Site, you grant InternetPrivacyScore a royalty-free, irrevocable, perpetual, non-exclusive, sublicensable, worldwide license to use, reproduce, modify, edit, distribute, perform and display any communication or other User Submissions you transmit to the Site (and the ideas contained in such material as well as the name submitted in connection with such materials, if we choose) for any purpose, anywhere, including without limitation reproducing, posting, broadcasting, or publicizing such material or using such material for marketing, advertising or other commercial purposes in any media. You further represent and warrant that you will defend and indemnify InternetPrivacyScore and its affiliates for all claims resulting from any User Submission you provide. This license and indemnity obligation will survive the termination of this Agreement and your use of the Site.

InternetPrivacyScore reserves the right to remove any User Submission from the Site for any reason.

User Submissions are subject to our DMCA Notice and Procedure for reporting claims of copyright infringement.
